1 Agreement to Terms

By accessing or using Penless Education (operated by Emohol, a registered partnership firm), you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

These Terms govern your access to and use of our website at penlesseducation.com and all related services, applications, and tools we provide.

2 About Penless Education

Penless Education is a cloud-based coaching center management platform developed and operated by Emohol. It enables coaching institutes, tuition centers, and training academies to manage students, attendance, fees, results, communications, and more — all from a single dashboard.

Our platform is a software-as-a-service (SaaS) product. Upon subscription, you receive access to the platform's tools and features for as long as your subscription remains active.

3 Eligibility

To use Penless Education, you must:

• Be at least 18 years of age
• Be legally authorized to operate a coaching or educational center
• Provide accurate, truthful, and up-to-date information during registration
• Not be barred from using such services under applicable laws of Bangladesh

By registering, you represent and warrant that all information you submit is accurate and that you have the authority to agree to these Terms on behalf of your organization, if applicable.

4 User Accounts

When you create an account on Penless Education:

• You are responsible for maintaining the confidentiality of your login credentials
• You are fully accountable for all activities conducted under your account
• You must notify us immediately if you suspect any unauthorized access to your account
• Each coaching center may have one primary owner account, with the ability to create sub-accounts for staff and teachers

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in cases of serious breach.

5 Subscription Plans & Payments

Penless Education offers multiple subscription tiers, including a free plan with limited features. Access to premium features requires a paid subscription.

• All payments are processed securely through SSLCommerz, a PCI-DSS compliant payment gateway
• Pricing details are presented before any purchase confirmation
• Subscriptions are billed on a monthly or per-student basis, depending on the plan chosen
• By initiating a payment, you authorize Emohol and SSLCommerz to process the transaction against your selected payment method

6 Service Activation

Upon successful payment, your subscription will be activated within 24 hours. In most cases, activation is instant. If activation is delayed beyond 24 hours due to a technical issue, please contact our support team.

7 Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation:

• You retain access to paid features until the end of the current billing cycle
• No further charges will be made after cancellation
• Fees already paid for the current period are non-refundable unless you qualify under our Refund Policy

8 Prohibited Activities

When using Penless Education, you agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable Bangladeshi law
• Attempt to gain unauthorized access to any part of our system
• Upload or transmit malicious software, viruses, or harmful code
• Misrepresent your identity or affiliation
• Scrape, harvest, or collect data from the platform without our written consent
• Use the platform to harass, abuse, or harm any individual or group
• Resell, sublicense, or commercially exploit our services without prior written approval

Violations may result in immediate account suspension and potential legal action.

9 Intellectual Property

All content, design, code, trademarks, and materials on the Penless Education platform are the exclusive property of Emohol. You are granted a limited, non-exclusive, non-transferable license to use the platform solely for its intended purpose. You may not copy, reproduce, modify, or distribute any part of our platform without explicit written permission.

Data you input into the platform (student records, attendance logs, etc.) remains your property. We do not claim ownership of your data.

10 Limitation of Liability

To the fullest extent permitted by law, Emohol shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including data loss, loss of revenue, or business disruption.

Our total cumulative liability to you shall not exceed the amount you paid us in the three (3) months preceding the claim.

11 Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh.

12 Changes to These Terms

We reserve the right to update or modify these Terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify registered users of significant changes.
